Subcontractors form

This is the person we will contact in case of emergency.

1. Definitions 1.1 “The Company” J.A Stott Carpentry Limited “The Sub-Contractor” The Sub-Contractor and those who the Sub-Contractor procures to carry out or assist in carrying out the job. 1.2 “Job” As described in the Company’s pricing schedule or agreed between the parties before commencement. 1.3 “Contract” Each job shall be a separate and entire contract. 1.4 Site” One or more locations where the work is carried out. 1.5 ‘JAS’ JA Stott Carpentry Ltd 2. Required Standards 2.1 Work shall be carried out in a neat proper and workmanlike manner in accordance with specifications, drawings, British Standards, Codes of Practice and NHBC requirements. 2.2 All materials whether supplied by the Sub-Contractor, us or others shall be fit for the intended use at the time of fixing. 2.3 All materials found to be unfit for the purpose shall be set aside and brought to the attention of the Company. 2.4 The Sub-Contractor shall ensure that materials are stored protected and handled correctly. 2.5 Excessive waste caused by the neglect of the Sub-Contractor will be chargeable to the Sub-Contractor. 3. Duration 3.1 Carrying out one or more jobs shall not entitle the Sub-Contractor to any other jobs. Nor shall the Sub-Contractor be obliged to carry out further jobs. 3.2 If work is sub-standard or if the Sub-Contractor fails to conform to the Company’s programme the Company has the right to end the contract and only to pay for the part of the job completed. 4. Invoicing & Payment 4.1 All jobs undertaken by the Sub-Contractor shall be undertaken strictly to a schedule of prices. 4.2 The Sub-Contractor shall make himself available to agree details of jobs completed or in progress. The company shall provide details of the valuation of these jobs to the Sub-Contractor. 4.3 The Company will process Sub-Contractors’ payments on a regular basis based on these valuations. 4.4 Where a Sub-Contractor is registered for VAT the Sub-Contractor must submit invoices. 4.5 The rates and prices include a provision for the subcontractors paid holidays 4.6 The Company shall be entitled to make deductions for incomplete or defective work. 5. Tools & Clothing 5.1 Sub-Contractors are obliged to provide at their own expense all tools of their trade, plant and equipment and Personal Protective Equipment. 5.2 If the Company makes Health & Safety Personal Protective Equipment available to the Sub-Contractor the cost will be deducted from payments to the Sub-Contractor. At the following costs Gloves £3, Basic face masks F.O.C, Eye protection £2, Foam ear protectors F.O.C, Hard Hat £10, Hi Visibility vests £3 6. Health & Safety 6.1 The Sub-Contractor shall comply with all obligations imposed on the Sub-Contractor at common law, Acts of Parliament & H&S Legislation 6.2 Sub-Contractors must comply with the JA Stott Carpentry Ltd Health & Safety Policy and Principle Contractors Health & Safety procedures as indicated at Site Inductions and as other Building Procedures, advice, systems and working methods applicable to each site 6.3 All employees are licensed, registered, qualified, competent and experienced (as appropriate) to undertake the tasks for which they are engaged under the contract 6.4 Sub-Contractors to provide, wear and/or use personal protective equipment (PPE) and clothing appropriate to the hazards faced when undertaking the contract 6.5 The Sub-Contractor shall report to the Company all injuries, diseases and dangerous occurrences which occur on the site involving the Sub-contractor. 6.6 Any Health & Safety Instructions not followed will lead a verbal warning being issued and the Offending Sub-Contractor will be required to attend an additional site induction and re-brief of the Method statements and Risk assessments, any further Health & Safety infringements will lead to removal from site which may lead to dismissal. 6.7 All persons including subcontractors and all sublet contractors must be inducted and issued with a method statement & risk assessment at prestart briefings. 6.8 All Sublet contractors must complete an abridged JAS starter / induction pack. 7. Incomplete & Defective Work 7.1 The Sub-Contractor shall be liable for and shall make good at its own expense any defects in the works for which it is responsible. The Company shall have the right to instruct others to rectify such defective work and to charge the cost to the Sub-Contractor. 8. Rubbish The Sub-Contractor shall as work proceeds clear away all rubbish resulting from the execution of the Sub-Contract works on a daily basis 9. Resources 9.1 The Sub-Contractor must employ sufficient resources and labour to meet the programme. 9.2 The Sub-Contractor himself shall always be available on site whilst work is in progress or alternatively his representative shall be available. 9.3 All Employees & Subcontractors employed by the subcontractor shall be eligible to work in the UK & sufficient checks must be carried out by the subcontractor to ensure such is the case, as Home Office guidelines. 10. Indemnity and Insurance 10.1 The Sub-Contractor shall be liable for and shall indemnify the Company against any liability incurred by the Company in respect of any personal injury to or death of any person or in respect of loss or damage to any property which is due to the negligence, breach of statutory duty, omission or default of the Sub-Contractor its agents or workmen. 10.2 Without prejudice to the foregoing, the Sub-Contractor shall maintain Public Liability Insurance of £1million for any one event. 11. Medical consent and access to medical reports 11.1 It may be necessary for the Company’s Medical Advisor to communicate with your doctor. You have the right to see any medical report prepared by your doctor before it is sent to the Company Medical Advisor. The information will be treated in confidence. Information in the report relating to your work may be passed to the Company. By signing and dating this form you agree to authorise your doctor to reply to any query concerning your health or medical history. 12. Permission to release personal information 12.1 By signing and dating this form you authorise J A Stott Carpentry Ltd to release your details to 3rd party external organisations for inclusion in their database. The data will only be used for business purposes and will not be added to any external direct mailing lists or released to any other parties 13. General 13.1 Nothing in these Conditions shall constitute a partnership or any relationship of employer or employee between the Sub-Contractor and the Company.

We require all applicants to declare any conviction(s) or charge(s) still outstanding against them in respect of a criminal offence, subject to the Rehabilitation of Offenders Act 1974. Failure to declare a conviction may disqualify you from an appointment or result in the termination of your contract. If you inadvertently disclose a conviction which is regarded as ‘spent’ it will be ignored unless you are applying for work which is not protected by the Act.
